Terms of Service

These Terms of Service (“Terms”) govern your use of the Talkbooks application and services (“Service”) operated by Talkbooks (“we”, “our”, or “us”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Account Registration

  • A valid email address and password are required to create an account.
  • Email verification is mandatory before full access to the Service.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You are responsible for all activity under your account.
  • You must be at least 13 years old to use the Service.
  • Notify support@talkbooks.app immediately for suspected unauthorized access.

2. Acceptable Use

You agree not to:

  • Use the Service for illegal or unauthorized purposes.
  • Attempt unauthorized access to systems or accounts.
  • Interfere with service integrity or performance.
  • Deploy automated scripts, bots, or excessive tools.
  • Upload viruses, malware, or harmful code.
  • Store or process data violating applicable laws.
  • Resell or sublicense access without permission.
  • Impersonate others or misrepresent affiliations.

3. Subscription Plans and Billing

  • Free: $0/month. Limited entities, personal finance tracking only.
  • Pro: $9.99/month or $89.99/year. Unlimited entities, full history, inventory and order management.
  • Team: $24.99/month or $199.99/year. All Pro features plus unlimited members per entity.

Billing is through the Apple App Store or Google Play Store. Payment and refunds are subject to their respective terms.

4. Cancellation and Downgrades

  • Cancellation is available anytime through app store settings.
  • Your account reverts to the Free tier upon cancellation.
  • All your data is retained and remains readable after a downgrade.
  • Paid features become inaccessible upon downgrade.
  • Team members remain associated but new invitations are blocked.

5. AI Assistant and Data Accuracy

  • The AI may occasionally misinterpret input or produce inaccurate results.
  • You are responsible for reviewing and verifying all AI-entered data.
  • Talkbooks is not a substitute for professional accounting, financial, or legal advice.
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated responses.
  • You should not rely solely on the platform for critical financial decisions.

6. Your Data

  • You retain ownership of all data you enter.
  • You grant us a limited license to store, process, and display your data.
  • We do not sell, share, or use your data for advertising.
  • Account deletion is available in-app or via support@talkbooks.app.

7. Team and Entity Access

  • Owners can invite members with specific roles (manager, staff, viewer).
  • Owners are responsible for their members' compliance with these Terms.
  • Owners can remove members at any time.
  • Team member data is owned by the entity owner.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance and updates may temporarily affect access. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice.

9. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is capped at amounts paid in the preceding 12 months.

10. Indemnification

You agree to indemnify and hold harmless Talkbooks from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

11. Termination

We may suspend your account for Terms violations. You may terminate your account through the app or by contacting support. All rights cease immediately upon termination. Provisions regarding liability limitations and governing law survive termination.

12. Intellectual Property

The Talkbooks name, logo, marks, designs, and content are proprietary. Use requires prior written consent.

13. Changes to These Terms

Material changes will be communicated via the app or email. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

15. Apple-Specific Terms

  • Your subscription agreement is between you and Talkbooks, not Apple.
  • Apple provides no maintenance or support for the Service.
  • Apple is not responsible for product claims.
  • Apple is a third-party beneficiary upon your acceptance of these Terms.
